Terms of Service

Introduction

These Terms of Service (this "Agreement") are made between BarkHouse Enterprises LLC ("BarkHouse," "we," "us," or "our") and you, or if you represent an entity or organization, that entity or organization (in either case, "You").

BarkHouse offers an online service platform ("Platform") through our website ("Site") that allows you to access various services, functionality, and resources ("Services"). By accessing or using the Platform or Services, you agree to be bound by the terms of this Agreement.

Eligibility

You must be at least 13 years old to access or use the Platform or Services. If you are between 13 and 18, you may use the Platform only with the permission of a parent or guardian who agrees to be bound by this Agreement. By using the Platform, you represent that you meet these eligibility requirements.

Modifications to the Platform and Services

BarkHouse reserves the right to modify the Platform, Services, or this Agreement at any time. Such modifications will be effective immediately upon posting on the Site or otherwise notifying you. By continuing to use the Platform or Services, you agree to be bound by any such modifications.

Orders and Confirmation

All orders you place for Services will be governed by the terms of this Agreement. BarkHouse will confirm your order either through the Platform or by providing access to the Services. In case of any conflict between the terms of your order and the confirmation, the confirmation will govern.

Term and Termination

This Agreement is effective from the date you first use the Platform or Services. You may terminate this Agreement at any time by notifying BarkHouse in writing. BarkHouse may also terminate this Agreement at any time with or without notice if you breach any terms of this Agreement. Upon termination, all rights granted to you under this Agreement will cease immediately.

Subscription and Fees

During the term of this Agreement, BarkHouse will provide you with a subscription to access and use the Services. All fees associated with the Services must be paid in accordance with the terms set forth in your order. Fees are non-refundable, and failure to pay may result in suspension or termination of your access to the Services.

Use of the Platform and Services

You may access and use the Platform and Services solely for lawful purposes and in accordance with this Agreement. Unauthorized use, including but not limited to, reverse engineering, modifying, or distributing any part of the Platform or Services, is strictly prohibited.

Confidentiality

Both parties agree to protect each other's confidential information with the same degree of care they use to protect their own confidential information. Confidential information may not be disclosed to any third party without prior written consent, except as required by law.

Limitation of Liability

BarkHouse will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or Services. Our total liability will not exceed the fees you paid for the Services in the month preceding the claim.

Governing Law and Dispute Resolution

This Agreement will be governed by and construed in accordance with the laws of Texas. Any disputes arising from this Agreement will be resolved through binding arbitration in Dallas, in accordance with the rules of the American Arbitration Association.

Changes to the Terms of Service

BarkHouse may update these Terms of Service from time to time. Any changes will be posted on this page, and your continued use of the Platform or Services constitutes acceptance of those changes.
